SERC-TERC Updates - March, 2021


The purpose of the SERC-TERC Updates is to identify and share new policies, guidance, and training resources that may be useful to the State Emergency Response Commissions (SERCs) and Tribal Emergency Response Commissions (TERCs).

Regulatory and Program Information Related to Chemical Safety and Security

Regulatory and Program Information Related to Chemical Safety and Security US Department of Labor’s OSHA issues proposed rule to update hazard communication standard On February 5, 2021, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) issued a proposed rule to update the agency’s Hazard Communication Standard (HCS) to align with the seventh revision of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS). OSHA expects the HCS update will increase worker protections, and reduce the incidence of chemical-related occupational illnesses and injuries by further improving the information on the labels and Safety Data Sheets for hazardous chemicals. Proposed modifications will also address issues since implementation of the 2012 standard, and improve alignment with other federal agencies and Canada.

Individuals may submit comments identified by Docket No. OSHA-2019-0001, electronically at http://www.regulations.gov, which is the Federal e-Rulemaking Portal. Read the Federal Register notice for details. The deadline for submitting comments is April 19, 2021.

EPA Enforcement Alert: Risk of Chemical Accident During Process Startup EPA has issued an Enforcement Alert to highlight the importance of accident prevention efforts during startup periods and other times of nonroutine operations. Chemical accidents can occur at any time, but there are times when facilities are more prone to accidents.


SolarWinds Orion

  • CISA has learned that certain critical infrastructure entities, in addition to federal, state, local governments, and other private sector organizations, have been compromised by an advanced persistent threat actor (APT) beginning in at least March 2020. CISA contacted more than 700 covered chemical facilities regulated under the CFATS Program via a letter in the Chemical Security Assessment Tool (CSAT) to inform them that their facility has been identified as having potentially downloaded an affected version of the SolarWinds Orion software.

  • CISA is making sure the facilities are aware of this threat and providing CISA’s recommended actions that can be found in Activity Alert (AA20-352A).

Chemical Facility Anti-Terrorism Standards (CFATS) Operational Updates

  • To date, the Cybersecurity and Infrastructure Security Agency (CISA) has received over 100,000 Top-Screen submissions from over 42,000 unique facilities. Of these, CFATS covers 3,281 facilities.

  • Additionally, the program has completed 4,315 Authorization Inspections, 6,889 Compliance Inspections, and 8,825 Compliance Assistance Visits.

  • On February 10, 2021 CISA received its 100,000th Top-Screen submission. This milestone is a testament to the dedication that both industry and government agencies have displayed to the chemical security mission as we work to enhance chemical security across the country. Training Opportunities and Conferences

NASTTPO Monthly Webinars for 2021

The National Association of SARA Title III Program Officials (NASTTPO) plans to host a monthly webinar/workshop/training session that is of interest to membership and others. They will be held on the third Tuesday of each month at noon eastern for a one- or two-hour session using GoToWebinar. Virtual Computer Aided Management of Emergency Operations (CAMEO) Training

Tom Bergman is now offering virtual CAMEO Training using Zoom software. Two courses are currently available:

·         8-hour course on using CAMEO for local facility hazard analyses for LEPCs or emergency management personnel

·         8-hour course on using CAMEO for local hazmat incidents designed for first responders and hazmat technicians

Ammonia Safety and Training Institute (ASTI) Ammonia Safety Days Training

·         ASTI offers FREE ammonia safety training.

·         Each training is an 8-hour conference-style presentation designed for industry, firefighters, and regulators, addressing prevention of, and safe response to, ammonia emergencies.

·         Sample topics include: hazard analysis, equipment problems leading to emergencies, emergency shutdown, emergency control and containment, safety plans, personnel protection equipment, decontamination, integrating with public safety responders, monitoring systems, public receptors, communications, and safe escape or shelter.
